Organised Crime (Penalties and Sentencing) Bill
The Parliament of New Zealand enacts as follows:
1 Title
This Act is the Organised Crime (Penalties and Sentencing) Act 2008 .
2 Commencement
This Act comes into force on 31 October 2008.
3 Crimes Act 1961 amended
This Part amends the Crimes Act 1961.
4 Participation in organised criminal group
Section 98A(1) is amended by omitting 5 and substituting 10 .
Section 98A(1)(b) is amended by inserting is before reckless .
5 Sentencing Act 2002 amended
This Part amends the Sentencing Act 2002.
6 Aggravating and mitigating factors
Section 9(1) is amended by inserting the following paragraph after paragraph (ha): hb that the offender committed the offence partly or wholly because of his or her participation in an organised criminal group (within the meaning of section 98A(2) of the Crimes Act 1961): hb that the offender committed the offence partly or wholly because of his or her— i participation in an organised criminal group (within the meaning of section 98A(2) of the Crimes Act 1961); or ii involvement in any other form of organised criminal association: .
